ALBANY, NY (NEWS10) – While some municipalities have decided to opt out of adult-use marijuana dispensaries and / or on-site consumption salons in their jurisdiction. Failure to comply by the deadline will automatically drag a municipality into the retail market.

The Marijuana Taxation and Regulation Act enacted in March allows municipalities this option until December 31. However, failure to act before this deadline does not necessarily guarantee that a dispensary and / or consumer salon is located within their borders. While municipalities choose to withdraw by December 31, localities can still withdraw.

The Rockefeller Institute of Government has monitored the opt-out decision process for towns, cities, and towns across the state and recently launched the Marijuana Opt-Out Tracker to track the status of the opt-out process as it goes. ‘it is happening. The Opt-Out Tracker monitors municipal decision-making activities by examining local governing boards, newspaper articles, legal opinions for public hearings, passing of local laws, and submissions of local laws to the Department of state.

Albany County
